By accessing or using Kathapustak, creating an account, submitting information, placing an order, or otherwise using our services, you agree to be bound by these Terms and our Privacy Policy.

Personalized stories may contain information about children. We expect the service to be used under the direction and responsibility of a parent, guardian, or other authorized adult.

If you provide information about a child, you represent that you are authorized to provide that information for the requested purpose and will comply with applicable requirements concerning children's personal data.

Parents and guardians are responsible for reviewing generated content before sharing it with a child.

Kathapustak does not replace parental supervision, education, medical advice, psychological advice, professional advice, or other appropriate adult guidance.

Kathapustak may use artificial intelligence and automated technologies to generate or personalize stories, illustrations, audio, recommendations, or other content.

You understand that AI-generated content is created using automated systems and may not always be factually correct, consistent, complete, or appropriate for every situation.

AI-generated content should be treated as creative and educational entertainment rather than as professional advice.

You are responsible for reviewing generated content before using, printing, sharing, or distributing it.

Generation does not guarantee identical results

Personalized generation may produce different results based on the information provided, available generation systems, technical conditions, or other factors. We do not guarantee that every generated story or illustration will exactly match your expectations.

AI availability

AI-powered features may occasionally be unavailable, delayed, modified, limited, or replaced by another technology.

You may be able to provide photographs, text, preferences, names, descriptions, or other material ("User Content") for the purpose of creating personalized experiences.

You retain ownership of User Content that you lawfully own, subject to the rights and permissions necessary for us to provide the service.

Your responsibility

You represent that you have the necessary rights, permissions, and authority to provide User Content and allow Kathapustak to process it for the requested service.

For example, if you upload a photograph containing another person, you should have the appropriate permission or lawful authority to use that photograph for the requested purpose.

License necessary to provide the service

By submitting User Content, you grant Kathapustak a limited, non-exclusive, worldwide license to host, store, reproduce, process, transform, transmit, and otherwise use that User Content only as reasonably necessary to provide, secure, maintain, and improve the requested services, subject to our Privacy Policy and applicable law.

This license does not transfer ownership of your User Content to Kathapustak.

The Kathapustak name, brand, logo, website design, software, interface, visual elements, trademarks, service marks, and other proprietary materials are owned by or licensed to Kathapustak and are protected by applicable intellectual-property laws.

Except as expressly permitted by these Terms, you may not copy, reproduce, modify, distribute, sell, license, reverse engineer, or commercially exploit our proprietary materials.

Your personalized story

Subject to these Terms, applicable law, and the rights of third parties, we do not claim ownership of User Content that you provide to create a personalized story.

Where applicable, you may use the resulting personalized content for your personal, non-commercial purposes, subject to any third-party rights and applicable limitations.

Because AI-generated content can involve multiple underlying technologies and third-party rights, Kathapustak does not guarantee that every generated output qualifies for exclusive copyright protection or that no third party could have rights relating to an output.

Third-party materials

Some fonts, software, technologies, payment services, media, or other components used by the service may be subject to separate third-party licenses or terms.

Kathapustak may offer digital stories, printed storybooks, and other personalized products.

Before confirming an order, you are responsible for reviewing the information you provide, including names, addresses, personalization details, and selected product options.

Personalized products may be produced specifically for you based on the information submitted during the order process.

Product appearance

Colors, typography, illustrations, and physical appearance may vary slightly between screens, digital previews, printing systems, and physical materials.

Generated illustrations and layouts may also vary from previews or examples shown on the website.

Order acceptance

An order confirmation does not necessarily mean that an order cannot be cancelled or rejected. We may refuse or cancel an order where reasonably necessary, including because of payment problems, technical errors, suspected fraud, unavailable products, or other legitimate operational reasons.

Prices, taxes, shipping charges, and other applicable fees will be presented during the purchase process where required.

You agree to provide accurate billing and payment information and authorize the applicable payment provider to process the transaction.

Payment processing may be handled by third-party payment providers. Their own terms and policies may also apply.

We may correct obvious pricing, description, or technical errors before fulfilment where permitted by applicable law.

Refunds, cancellations, returns, replacements, and shipping-related remedies are governed by our applicable policies and mandatory consumer rights.

Physical products are delivered using available shipping and courier services to the address provided during checkout.

Delivery estimates are estimates rather than absolute guarantees and may be affected by production time, courier operations, weather, holidays, incorrect addresses, or events outside our reasonable control.

You are responsible for providing an accurate and deliverable shipping address.

We may modify, add, remove, or replace features over time as the product evolves.

Kathapustak may depend on third-party services for infrastructure, AI generation, payments, email, storage, shipping, analytics, authentication, or other functionality.

Third-party services may have their own terms, policies, limitations, outages, and availability requirements.

We are not responsible for independent services outside our reasonable control, although we will take reasonable steps to address material third-party failures affecting our service.

You may stop using Kathapustak at any time and may request account deletion in accordance with our Privacy Policy.

We may suspend or terminate access where reasonably necessary if you:

• Materially violate these Terms.
• Use the service unlawfully.
• Attempt to compromise our systems or security.
• Engage in fraud or abusive activity.
• Provide information that is materially false or misleading.
• Create an unreasonable security or operational risk.

Where appropriate and legally permitted, we may provide notice or an opportunity to resolve a violation before restricting an account.

Termination does not automatically eliminate rights or obligations that arose before termination.

To the maximum extent permitted by applicable law, Kathapustak provides the services on an "as available" and "as is" basis, subject to any warranties or rights that cannot legally be excluded.

We do not guarantee that:

• Every AI-generated story will be factually accurate.
• Every generated illustration will exactly match a supplied photograph or expectation.
• Every story will produce a particular emotional, educational, behavioral, or developmental outcome.
• The service will always be uninterrupted or error-free.
• Every generated result will be suitable for every individual child or family.

Parents and guardians remain responsible for reviewing and deciding whether content is suitable for their child.

To the maximum extent permitted by applicable law, Kathapustak and its officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the service.

This may include loss of profits, loss of data, business interruption, loss of goodwill, or other indirect losses, except where such limitation is prohibited by law.

To the maximum extent permitted by applicable law, our aggregate liability arising from a particular claim relating to the services will be limited to the amount you paid to Kathapustak for the relevant service giving rise to the claim during the applicable period, subject to mandatory legal rights and exceptions required by law.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

To the extent permitted by applicable law, you agree to be responsible for losses, claims, liabilities, and reasonable costs arising from your unlawful use of the service, material violation of these Terms, or infringement of another person's rights through User Content you provide.

This provision does not require you to indemnify us for matters caused by our own unlawful conduct or obligations that cannot legally be transferred to you.

We aim to investigate legitimate complaints and provide an appropriate response within a reasonable period, subject to the nature of the issue and applicable law.

Subject to applicable law and any mandatory dispute resolution mechanism, courts having appropriate jurisdiction in Maharashtra, India may have jurisdiction over disputes arising from these Terms or the services.

We may update these Terms when our services, business practices, technology, or legal requirements change.

When material changes are made, we will take reasonable steps to provide appropriate notice.

Your continued use of the services after the updated Terms become effective means that the updated Terms will apply to your future use, to the extent permitted by law.
